Beat business is monstrous these days and you can comfortably buy instrumentals online with very good pricing. Everything from hiphop instrumentals to pop and even to jazz style beats. But one thing is mandatory when buying and that is if the instrumental contains samples or not.
What is an sample?
If some instrumental has used samples it would mean that it has taken some parts of other tracks and used it on it’s own. In example someone could take a cello from some Britney Spears record and make a totally new version of it. That’s sampling. In hiphop sampling is a very common thing and it is basically in the hip hop community to use samples. It is also very typical to use samples and pitch them higher or lower and cut it that it sounds entirely different. Some producers make it sound genious because some samples are close to impossible to discover. That is good sampling. But of course some samples sound amazing by just cutting them to 10 sec loops but they are easy to notice.
Is it legal to use samples?
There are many things which have to be noticed here. Whenever producers sell beats with samples on them they write in the contract that the customer is responsible of the sample. So basically it’s your duty to get permission to use the samples if you use them for profitable purposes. If the song is just for the internet so sample clearing is not really needed. Internet is full of tunes with samples but because they don’t make any money with them so no one really cares. But if you use the tracks on an album which sells thousands of copies so then you should maybe consider getting permissions. It also depends on the song and artist it was sampled from and how good the sampling was. If the sample has been cut and totally re-arranged that it’s impossible to notice, then I wouldn’t worry about it. But if it’s a straight 5-10 second loop so then it’s a different case because it’s very easy to notice.
Are hiphop instrumentals with samples better than original instrumentals?
This also depends. Original beats are much easier in a way because you don’t have to think of sample permissions. But quite often beats with samples have a totally different feel which cannot be achieved smoothly with original beats. So in the end all really depends on what you like and what you want to do. Just make sure when you download instrumentals you know if the beat contains samples when you have purchased it and you get all the sample information.
